Applewhite v. Hyundai Motor Am., et al.

The Plaintiffs’ three decedents were traveling in a 1993 Hyundai Excel on Highway 61 when it collided with at Lincoln Towncar. The Lincoln remained fully intact, and all its passengers survived without fatal or permanent injuries, and the Hyundai Excel disintegrated into three distinct pieces upon impact leaving its occupants exposed to the highway. Plaintiffs pursued a crashworthiness claim against the Defendants.
The jury returned a $4,500,000 verdict for the Plaintiffs. The case was remanded for a new trial by the Mississippi Supreme Court for a second trial.
The second trial was held in September 2014, and the jury returned a $10,500,000 verdict for the Plaintiffs. Hyundai is appealing again.
