The case involved Defendants prescribing to Barbara Huss, who was pregnant, a drug called Terbutaline, which is utilized for suppression of early or false labor. As a result of the administration of Terbutaline, Barbara Huss suffered permanent cardiomyopathy, rendering her disabled. This case proceeded to trial and on or about August 24, 2004, a jury reached a unanimous verdict, finding for the Plaintiff, and ordering the Defendants to pay a judgment in the amount of $3,500,000.00.
